PHILIPPI — A Belington man has been charged with three misdemeanors after two juveniles he allegedly provided alcohol to drink and were involved in a single-vehicle wreck last September that killed one of them.
Gregory C. Ross, 45, was charged with one count of contributing to the delinquency of a minor, and two counts of providing alcohol to a minor. He was released on a $3,000 personal recognizance bond after an initial appearance last week before Barbour Magistrate Tina Mouser.
Ross was supplied $50 by a juvenile, and bought a 20-pack of Budweiser Light, a bottle of Captain Morgan spiced rum and a 24-pack of Michelob Ultra for the juvenile on Sept. 8, Barbour Sheriff’s Cpl. J.C. Casey has alleged.
“Mr. Ross also did state that the alcohol was purchased for the juvenile because of a party,” Casey has alleged. “The juvenile that the alcohol was given to by Mr. Ross, later that same evening did share the alcohol with another juvenile.
“After both juveniles had consumed some of the alcohol, they were involved in a motor vehicle crash that did claim the life of one of the juveniles,” Casey has alleged.
The wreck occurred on Pike Street in Philippi.
The vehicle crashed into a ditch and hit a tree root, Barbour Prosecutor Leckta Poling said. The 17-year-old male driver, not wearing a seat belt, was ejected from the vehicle and died, Poling said. The 17-year-old male passenger was wearing a belt, and was OK after treatment at a hospital, Poling said.
Ross could face up to a year in jail and a fine of up to $500 if convicted of contributing to the delinquency of a minor. He could face up to 10 days in jail and a fine of up $250 on each count of providing alcohol to a minor if he’s convicted of those charges.
Barbour Magistrate Clerk Sabrina Ward said Monday that no hearing date had been set yet.

— The state Supreme Court has upheld the conviction and sentencing of 47-year-old East View resident Frank Antrobius on four sex-related charges.
The justices ruled Harrison Chief Judge Thomas A. Bedell made no errors that would result in Antrobius getting a new trial.
The defendant is serving 20 to 40 years in prison. Unless he loses good time credit while behind bars, he will discharge the term at 20 years and begin serving 25 years of supervised release. He also will have to register as a sex offender for the rest of his life.
The victim was a juvenile.
Assistant Prosecutor Laura Pickens represented the state at trial and on appeal.
— Troi Amanda Foster, 19, of Bridgeport, and Dakota James Stutler, 23, of Clarksburg, have been charged with felony child neglect creating risk of injury.
The defendants were impaired while caring for Foster’s 6-month-old girl inside the West Pike Street McDonald’s, Clarksburg police have alleged.
Foster was in possession of Xanax that wasn’t hers, empty heroin stamps and drug paraphernalia, while Stutler possessed paraphernalia and acknowledged using heroin, police have alleged.
Bond was set at $25,000 for each defendant by Senior Magistrate Nancy Means.

— Steven Ray Smith, 30, of Clarksburg, has been charged with two felony counts of second-offense battery on an officer by Clarksburg policemen Timothy Criss and Aaron Jackson.
The lawmen dismissed misdemeanor counts to charge Smith with the felonies over the same set of allegations.
On Feb. 24, just days before he was to report to the North Central Regional Jail to await placement in a state prison, officers were called to Smith’s residence on Fowler Avenue in Clarksburg.
There, while police were speaking with Smith and his wife, the defendant pushed the woman into the residence, Criss and Jackson have alleged.
Smith pulled away from officers at one point while he was being detained, and he had to be restrained by Criss and Patrol Officer Brett Levine, court filings allege.
The defendant subsequently kicked Levine on the leg and, while at United Hospital Center for treatment for a dog bite to his hand, Smith spit on Jackson, Criss has alleged.
Smith was jailed following the alleged incident, and now is under state Division of Corrections custody, serving a total of 1-5 years for felony fleeing with reckless disregard, misdemeanor battery on a police officer and misdemeanor destruction of property.
If convicted on the new felony second-offense battery on an officer charges, Smith could face 1-3 years in prison on each count.
— Stephen Lucas Homer, 18, of Blue Ridge, Virginia, has been charged with second-degree robbery by Lewis Deputy G.P. Hoskins.
Homer robbed the Weston Market Place Shopping Center GNC store of $200, but was apprehended the same day as he tried to board a bus at the BFS store across U.S. 33, Hoskins has alleged.
State Police and Lewis deputies worked the case. Lewis Magistrate Roger D. Clem Jr. set bond at $20,000 cash and $190,000 personal recognizance.
— Randy Allen Blake, 26, of Mount Clare, has been placed on probation for 3 years for burglary, according to Assistant Prosecutor Pickens.
Harrison Circuit Judge John Lewis Marks Jr. imposed sentence on Monday.
— Tyrin Jamal Holyfield, 24, of Clarksburg, has waived his probable cause hearing before Harrison Magistrate Tammy Marple on a charge of possession with intent to deliver marijuana.
The Harrison County Sheriff’s Department alleges Holyfield possessed the drug during a traffic stop for defective equipment.
Holyfield was represented by Assistant Defender Eric Householder on Monday, while Harrison Prosecutor Susan Morris represented the state.
— Wesley Miller, 35, of Belington, has been charged with felony third-offense driving under the influence by Harrison Deputy Mark Senderak.
On Sunday, Miller was parked in East View with his pickup truck’s motor running, Senderak has alleged. Miller’s speech was slurred and he had trouble focusing, Senderak has alleged. The defendant then failed three field sobriety tests, the complaint alleges.
Miller’s bond was set at $5,000 by Senior Magistrate Means.
— Luke Allen Wilson, 36, of Walkersville, has been charged with entering without breaking in Lewis County.
Senior Trooper Zachary Cooper alleges Wilson entered a relative’s shed and took a utility vehicle Feb. 19, using it to try to pull a vehicle out of a ditch on Sapp Run Road.
The utility vehicle was returned, but had about $1,400 in damages, Cooper has alleged.
Wilson’s bond was set at $6,000 cash and $50,000 personal recognizance by Lewis Magistrate Clem.
— Kristen Leigh Shores, 29, of Rosemont, has been charged with felony false pretenses by Bridgeport Detective Jay Williams.
From Nov. 22 to Dec. 20, Shores pretended to scan merchandise at Gabriel Brothers in Bridgeport, but then gave items away, Williams has alleged. Total loss was about $5,600, the complaint alleges.
Means set bond at $5,000.
— Russell Alan King, 33, of Lumberport, has pleaded guilty to misdemeanor battery, resolving a case in which he initially had been charged with burglary.
King choked and punched his ex-wife’s current husband at a residence on Pratt Avenue, Harrison Deputy James Kennedy has alleged.
Harrison Chief Magistrate Frank DeMarco sentenced King to serve Saturday and Sunday in jail.
